Our focus

Our ports practice has experience across the spectrum of the ports from single and multi cargo ports including wet and dry bulk, RoRo and container terminals, naval ports, cruise and recreational ports. We see many of the issues faced in the ports sector as being similar to those which are encountered in the airports sector. We seek to leverage this experience in the solutions that we offer to our port sector clients to drive innovative solutions.

Clients advised in the Ports sector by our consultants include port operators such as the Commonwealth Department of Defence (Royal Australian Navy), Port of Brisbane Pty Ltd, Dalrymple Bay Coal Terminal, the Government of the Republic of Cyprus and terminal operators. Our consultant’s experience includes advising on significant projects such as the market led proposal by the Port of Brisbane Pty Ltd to develop the new Brisbane International Cruise Terminal, major terminal reconfigurations, strategic port redevelopment and a wide range of port developments, upgrades and service contracts. Port lands often entail complex tenure arrangements and we are experienced with the structures that most major ports utilise.

Jeremy’s experience in the Ports sector dates back to the mid 1990’s when he served a posting as the chief legal advisor to the RAN’s Commodore Fleet Bases.

 

Notable clients and projects

 

Port of Brisbane Pty Ltd

  • Advised on the Market-Led Proposal (MLP) to develop the Brisbane International Cruise Terminal. The project involved the greenfield development of a new mega cruise ship terminal, wharf and berthing facilities. Advice included initial structuring and competition considerations, negotiating all necessary MLP documentation with the State Government, negotiating the Development Agreement and long term operating rights with the State of Queensland, complex tenure arrangements, 93 year lease, structuring issues associated with the proposed development, negotiations with boarder security agencies and supporting infrastructure arrangements with the Brisbane City Council and Queensland Urban Utilities.

  • Advised on the expansion of the export coal handling facility.

  • Advised on the reconfiguration of the bulk cement terminal.

 

Port of Geraldton

  • Advised on a new terminal acquisition at the Port of Geraldton.

 

Dalrymple Bay Coal Terminal

  • Advised on capital dredging required for the Stage 7 Expansion.

  • Advised on numerous services and consultancy agreements.

  • Advised on regulatory and common law issues associated with shipping claims.

  • Advised on Force Majeure issues following cyclone events.
